Please read these Terms of Service ("Terms") carefully before using the Hubfly platform, CLI, and associated API services (collectively, the "Service").
1. Acceptance of Terms
By registering for or using Hubfly, you agree to be bound by these Terms. If you do not agree, strictly do not use the Service.
2. Account & Responsibilities
- Account Security: You are responsible for maintaining the security of your account credentials and API tokens (PATs).
- Project Ownership: The user who creates a project is the "Project Owner." The user who creates a specific resource (container, storage block) is the "Resource Owner" and is responsible for the costs generated by that resource.
- Team Activity: Project Owners are responsible for the activity and conduct of members they invite to their projects.
3. Service Usage & Restrictions
3.1. Acceptable Use
You agree strictly NOT to use Hubfly for:
- Illegal activities, malware distribution, or phishing.
- Crypto currency mining or other resource intensive tasks that degrade the platform for other users (unless explicitly permitted on Dedicated instances).
- Scanning, attacking, or testing the vulnerability of external networks without authorization.
3.2. Resource Limits
- Free Tier: Free instances are shared resources. We reserve the right to put free instances to "sleep" during idle periods or terminate them if they exceed fair use limits.
- Storage: Temporary storage is ephemeral. We are not liable for data lost when a container is stopped or restarted. You must use "Persistent Storage Blocks" for critical data.
- Tunnels: SSH Tunnels are ephemeral and intended for development/debugging. You agree not to use them for permanent, high-bandwidth content delivery.
3.3. Zero Tolerance for Illegal Content
We maintain a strict zero tolerance policy for illegal content. If you are found to be hosting or distributing illegal material (including but not limited to Child Sexual Abuse Material (CSAM), non consensual sexual content, terrorism propaganda, or stolen data), or if we receive a valid report regarding such content:
- Immediate Deletion: We will permanently delete the associated storage blocks, containers, and data without prior notice or opportunity for recovery.
- Account Termination: Your account will be immediately suspended or terminated.
- Law Enforcement Reporting: We will report your account details, access logs, and content to the relevant law enforcement authorities (e.g., NCMEC, FBI, Interpol).
4. Billing and Payments
4.1. Pay-Per-Use Model
- You agree to pay fees based on your actual resource consumption (CPU, RAM, Storage, Egress) as described on our Pricing page.
- Billing is calculated per second, minute, or hour depending on the specific resource metric.
4.2. Pre-Funding & Auto-Scaling
- Certain features, such as Auto-Scaling Instances, may require a pre-funded account balance.
- If your balance reaches zero, we reserve the right to suspend or terminate running instances immediately.
4.3. Refunds
- Fees are non-refundable except as required by law. Users are responsible for monitoring their own usage to prevent unexpected costs.
- No Refunds for Violations: Accounts terminated for violating Section 3 (Illegal Content) are not eligible for any refunds of remaining balances.
5. Intellectual Property
- Your Content: You retain all rights to the Docker images, code, and data you upload to Hubfly.
- Platform Rights: Hubfly retains all rights to the underlying platform, CLI software, API, and documentation.
6. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms (e.g., non-payment, abusive network traffic).
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Hubfly makes no warranties regarding the uptime, reliability, or availability of the Service, particularly regarding Free Tier instances.
8. Limitation of Liability
In no event shall Hubfly be liable for any indirect, incidental, special, or consequential damages, including loss of data (e.g., corruption of storage blocks), lost profits, or service interruption.
9. Governing Law
These Terms shall be governed by the laws of Country or state the project is deployed in, without regard to its conflict of law provisions.
